Objective

Introduce students to principles, rules and essential problems of civil procedure and differences from other procedural branches of law.

Tasks:
Learn to focus on all issues related to civil procedure, to prepare the conceptual framework for solving problems. Acquire the necessary knowledge of civil procedure and related phenomena. Improve students’ knowledge of procedural and civil rights, introduce students to the relevant terminology Prepare students for practical work with civil procedural documents and participation in court hearings. Broaden students’ understanding of the application of the Civil Procedure Law and the topical issues of the present day in reforming of the judicial system. The following tasks shall be fulfilled for the achievement of the objectives set for the study course: Acquire the normative acts related to the civil procedure and to get acquainted with literature, publications and judicial practices in civil procedure. Analyse and independently draft various civil procedural documents. Tackle independent assignments aimed at promoting creative thinking within the framework of law science.

Learning outcomes

Knowledge

Formulate basic principles of the civil procedure, as well as basic concepts of the Civil Procedure Law, understand the purpose of the civil procedure regulation, the practical need for individual special regulations. Describe the basic procedural framework governing the jurisdiction of civil disputes, the costs, procedural deadlines, the competence of the parties, the evidence, litigation at the court of first instance: raising a claim, provision of the claim, the trial, the court rulings, amicable settlement, aspects of handling certain categories of cases, special litigation procedure, enforcement of the obligations in court, the appeal, cassation appeal, the arbitration proceedings, the enforcement of court judgements, international civil procedure.

Practical skills for the application of the Civil Procedure Law. Understanding the role of the Civil Procedure in the legal system. Ability to analyse practical situations by understanding the nature of the applicable rules of the Civil Procedure Law and the rights and obligations of the parties. Promotion of scientific and research skills. Verbal and written communication skills on the issues of civil procedural rights. Knowledge of court practice and its critical analysis.
