About Study Course
Objective
The purpose of the study course is to enable students to acquire knowledge of the role of the Satversme (Constitution) of the Republic of Latvia (hereinafter – the Constitution) and other legislation of constitutional rank in the statehood of the Republic of Latvia; to develop skills in application of legislation of the highest legal validity and to develop the attitude that promotes respect for and protection of the values of a democratic and legal state.
Prerequisites
Legal Theory.
Learning outcomes
1.Knowledge
1. In-depth understanding of the interpretation and application of the norms of the Constitution of the Republic of Latvia (hereinafter – the Constitution);
2. Knowledge of the values enshrined in the Constitution and their protection mechanisms;
3. Understanding of the concept of a democratic state governed by the rule of law and its fundamental values.
1.Skills
1. Ability to use argumentation, polemics and abstract thinking in resolving complex legal conflicts.
2. Ability to apply the norms of the Constitution and general principles of law in practice. In particular, the ability to analyse the compliance of lower-ranking legal norms with the Constitution and to apply the test of legitimate aim and proportionality in cases of restriction of fundamental rights.
3. Skills in preparing constitutional complaints, applications or legal opinions, formulating legal grounds and arguments precisely.
4. Ability to find, analyse and integrate the case-law of the Constitutional Court, as well as the European Court of Human Rights and the Court of Justice of the European Union, in the context of national law.
1.1. Ability to independently identify and solve complex issues in the process of law enforcement.
2. Ability to critically assess the interaction of branches of state power, the system of separation and balance of power, as well as the observance of the principles of the rule of law and good governance in public administration.
3. Evaluate the compliance of legal regulations with higher legal force norms, ensuring a balance between individual freedoms and public interests.
4. Ability to harmonize and apply Latvian constitutional law in synergy with international human rights norms and the requirements of the supremacy of European Union law.
